Auto Link Terms and Conditions

“Hyundai” means Hyundai Motors New Zealand Limited and any associated company, and their officers and employees thereof.

By downloading and registering for the Auto Link App (the “App”), you accept these terms and conditions, and the privacy policy available at www.hyundai.co.nz/auto-link-privacy-policy. Please read these terms carefully.

Hyundai may change these terms from time to time. Hyundai will publish these changes on the App. By continuing to use the App, you’ll be taken to have accepted the latest version of these terms, and it’s up to you to check for any changes.

Registration

To use the App, you must complete the registration process in the App. If you are signing up in the name of an organisation, the individual completing the sign-up process personally undertakes that they have the authority to accept these terms on behalf of the organisation.

Using the Auto Link App

In order to use this App to receive the Hyundai Auto Link services, you will need a compatible mobile device such as a smartphone. You shall be solely responsible for the costs of supplying, maintaining and operating your mobile device, including telecommunications costs. Your telecommunications service provider may charge you fees to access or transmit data. You are responsible for any fees that you incur in connection with your use of this App (including when updating the hardware, firmware and software, both in your Vehicle and the App). Contact your telecommunications service provider for more information regarding data rates and fees.

The proper operation of the Hyundai Auto Link service may be affected by the settings (including settings relating to location services), configuration or features of your mobile device, and by the coverage or quality of the telecommunications services that you have purchased in conjunction with your mobile device. Hyundai is not responsible for any limitations, restrictions, features or effects of your mobile device or the relevant telecommunications services.

You are responsible for protecting your passwords and other login information. You are responsible for any usage of your account using your login credentials. You must notify Hyundai immediately on becoming aware of any actual or suspected unauthorised use of your account.

You must not use the App in a way that infringes intellectual property, defames someone, breaks the law, or violates the privacy or other rights of any person. You must not use your mobile device or the App while driving.

You must not use the App to:
• upload, transmit, or distribute any malware or spyware;
• interfere with or disrupt any servers or networks connected to Auto Link;
• attempt to gain unauthorised access to any Auto Link servers or networks, or another person’s account; or
• do anything that would expose us to any liability or cause us to be in breach of any law or regulation of New Zealand or any other jurisdiction.

Interruptions and accuracy of information

Not all Hyundai Auto Link services are available everywhere, particularly in remote or enclosed areas, or on all vehicles, at all times. The operation of the location services may be affected by your location, activation or deactivation of location services on your mobile device, and the services provided by your telecommunications service provider. Some Hyundai Auto Link services may not be fully available if the GPS system or other mobile device features are not working. It is up to you to take any precautions necessary to ensure you do not incur losses or costs in the event that the App is affected by an interruption or error. Hyundai is not liable for any loss or corruption of data.

Hyundai will use reasonable efforts to ensure that information, advice and data provided through the App is accurate and that the services operate as described. To the extent permitted by law, Hyundai excludes all other express and implied warranties and representations about that information, advice, data and operation of the services through the App. Hyundai accepts no liability for the accuracy, currency or completeness of information, advice or data provided by the App.
Intellectual property rights

Hyundai owns or hold rights to use all intellectual property rights in the App, including all components of the App, and all content made available through the App from time to time.
Limitations on our liability

As far as permitted by law, Hyundai is not responsible for any loss or damage that you may suffer in connection with your use of the App, except to the extent that Hyundai causes or contributes to the loss or damage through its breach of these terms or unlawful conduct.

As far as permitted by law, Hyundai will not be liable to you for any loss of profits, opportunity, business or contract, any indirect or consequential loss, or any exemplary, incidental, special or punitive damages, arising from or in connection with the App or these terms.

Consumer Guarantees Act and Fair Trading Act

Nothing in these terms takes away from your rights under the Fair Trading Act and Consumer Guarantees Act.

Governing law

These terms are governed by New Zealand law. You submit to the exclusive jurisdiction of the courts of New Zealand in relation to all disputes arising out of or in connection with these terms and/or the Auto Link app.
